The court considered whether the defendant, a passenger in a motor
vehicle determined to be stolen, had a reasonable expectation of privacy
in the vehicle's contents. U.S. Const. amend. IV; N.J. Const. art. I, ¶
7. The court declined the State's invitation to formulate a bright-line
rule as a matter of law, that an individual operating or occupying a
stolen motor vehicle, regardless of their knowledge of its status, does
not have a reasonable expectation of privacy. The question whether
defendant had a reasonable expectation of privacy required a fact
sensitive inquiry.
